A New Law Changes Vape Shipping Policies

Believe it or not, a new law passed by Congress will prohibit the United States Postal Service from shipping vape products to residential homes beginning this summer. Does it sound ridiculous? That’s because it is.

“In late December, when Congress approved an appropriations bill to keep the government running, lawmakers included the text of a separate measure,” writes Marijuana Business Daily. “The “Preventing Online Sales of E-Cigarettes to Children Act” prohibits the USPS from shipping vaping products.” 

The new law actually doesn’t mention hemp or cannabis businesses whatsoever, according to experts. Still, many of them are taking precautions just in case (because you know how the federal government can be when it comes to these things). 

According to what we know, the new legislation takes effect in late March. Once it does, the postal service has 120 to enact rules and implement the law as they see fit. As it is right now, the new law has everyone running a bit scared. According to statements released by both UPS and FedEx, each organization will follow the path of the USPS and stop shipping vapes as well. 

“Effective April 5, 2021, UPS will not transport vaping products to, from or within the United States due to the increased complexity to ship those products,” Matthew O’Connor, a UPS spokesman, said in a statement, according to Marijuana Business Daily.

A Law Made for Nicotine Products

The new law, which affects the shipping of all vaping products, was designed to curb youth vaping of nicotine products. What is happening right now is that Congress is interrupting a $44 million national marketplace. CBD and Delta-8 vape products are some of the most popular products on the market today.

In fact, many see this as just another attempt by those in power to demonize vaping. “[It’s] another attempt by the government to ‘demonize’ nicotine vaping,” Arnaud Dumas de Rauly, CEO and co-founder of The Blinc Group, told Marijuana Business Daily.

Still, there are things that can be done to lobby Congress. Experts agree that since the USPS has a few months to go before their final rules are implemented, there’s plenty of time to lobby.

“The first thing (for cannabis business owners) to do is to become aware of the law and whether or not it will affect them. And if they’re a (vaporizer manufacturing) company or retailer of vaping products, this will affect them,” cannabis attorney Rod Kight said to Marijuana Business Daily.
