We’re 10 days into the new year, and things aren’t looking so great. If you recall, and we think you might, it was only a few months ago that state after state began to ban or restrict Delta-8 THC. Well, now, in at least one state, it seems like things have backfired on them.

So what’s going on? Well, as we’ve reported before, the Texas Department of Health keeps trying to ban Delta-8 THC, and Delta-8 THC keeps winning! And here at Diamond CBD, we love a winner!
“In true Texas fashion, several Texas-based business owners banded together to fight the Texas DSHS and their injunction to completely prohibit the sale of Delta 8 THC,” noted the Fort Worth Weekly. “According to NBC DFW Channel 5, ‘A Texas district judge ruled on Monday in favor of removing Delta-8 THC from the state’s list of controlled substances until the court determines whether the state followed the law when it ruled the hemp-derived products illegal.’”
It’s a temporary victory, but it’s a victory nonetheless. “Considered to be a victory for Texas-owned hemp businesses, the overturning of this injunction is temporary. – In light of the court ruling, DSHS filed a motion with the Texas Supreme court to reinstate a ban against Delta 8 products,” the site continued.

What Happened to Delta-8 THC In Texas?
For those of you not in the know or those who just prefer to stay away from all of the bad news in the world (and believe us, there’s enough), Texas has been trying to ban Delta-8 THC for a very long time. Imagine waking up one day, and all of your favorite products are just gone from store shelves. There are no more Chill Plus concentrates, no more 10X Delta-8 THC vapes, heck you can’t even find Alibi THC-O.
All of these products are federally legal under the Farm Bill passed by Congress and signed by the President of the United States in 2018. When hemp became legal, so did all of its byproducts — Delta-8 THC, Delta-10, THC-O, HHC, THCV, CBD, CBG, and so much more. But (and there’s always a but), because some of those can give you a buzz, give you a high, or cause euphoria, it rattled the chain of some folks in local state legislatures. And those folks need votes.
“In late October, DSHS abruptly specified that Delta-8 is a Schedule I controlled substance, therefore illegal in Texas,” wrote the Fort Worth Weekly.
The site continued: “Without consideration to the economic impact, this “overnight ruling” was quickly scrutinized and deemed reckless by Texas-based hemp companies as they were left scrambling, finding ways to keep their doors open and employees paid. With 100s if not 1000s of businesses being based out of Texas, this seemingly permanent ruling would completely cripple the Texas hemp industry and potentially have a nationwide catastrophic ripple effect.”
See, Delta-8 isn’t just a great product, but these days legal. All-natural, hemp-derived cannabinoids keep the economy rolling. They help people find jobs and put food on the table. But the folks in charge never think about that.
But in Texas, things went a bit differently.
The Good News Is, Delta-8 THC Keeps Winning — And So Do You!
For now, this story seems to have a happy ending, even though it is far from over. The courts ruled that Texas officials went too far when they tried to ban Delta-8 THC overnight. Such efforts not only took away a great cannabinoid from so many people but, as the Forth Worth Weekly noted, it crippled the hemp industry, forcing shops to close and people to lose their jobs. In the middle of a lousy economy, during a pandemic, that’s just a bad idea.
More and more, though, folks are beginning to realize that Delta-8 THC isn’t just a cannabinoid that gets people high. It’s an all-natural hemp-derived cannabinoid that’s safe and legal (and gets people high). And as long as you’re safe, there’s nothing wrong with a little extra buzz or euphoria in your life.
“For now, DSHS is continuing its efforts in the pursuit against Delta 8 THC and will once again plead its case in January. Fortunately for Texas-based hemp providers, Delta 8 THC is seemingly resilient and has continued to fight back and win,” wrote the Fort Worth Weekly.
